Operator Agreement

This agreement covers your use of Ojapest as a professional: the subscription you pay for, what it includes, and what happens if it ends. It is between you and Andre Blunt Kft. If you are a customer booking an appointment, the terms that apply to you are our Terms of Service instead.
Who we are
Ojapest is a product of Andre Blunt Korlátolt Felelősségű Társaság (Andre Blunt Kft), a limited liability company registered in Hungary. Andre Blunt Kft is the contracting party under these terms. "Ojapest" is a product name, not a separate legal entity.

What Ojapest is, and what it is not
Ojapest is booking software. You use it to publish a booking page, manage your availability, take appointments, and optionally collect deposits. You provide the actual service to your clients and you are solely responsible for it.
Ojapest is not a marketplace and does not send you clients. We do not set your prices, your hours, or your policies, and we are not a party to any appointment you take.
Your subscription
Ojapest costs EUR 14 per month, or EUR 140 per year. If you are established in Hungary you are billed in forint instead: 5490 Ft per month, or 54 900 Ft per year. The yearly price is ten months of the monthly price, so two months are free. There is one plan and it includes every feature.
Prices include VAT. The amount above is the total you pay, whatever your country and tax status: we do not add tax at checkout. Where VAT applies it is calculated out of that amount at the rate for the place you are established, and is shown separately on your invoice. If you are a business established outside Hungary and give us a valid EU VAT number, we invoice you without Hungarian VAT under the reverse charge and you account for VAT yourself. The amount you pay us does not change.
Your first 30 days are free. A valid payment method is required to start, and we do not charge it during the free period.
The free period converts automatically
At the end of the free 30 days your subscription starts automatically and your payment method is charged for the interval you chose, unless you cancel before then.
You can cancel at any time during the free period and you will not be charged anything at all. Cancelling is a single action in your billing settings and takes effect immediately.
We will email you before the free period ends so the first charge is never a surprise.
Renewal and cancellation
Your subscription renews automatically at the end of each interval, monthly or yearly, until you cancel it.
You can cancel at any time from your billing settings. Cancellation stops the next renewal; it does not shorten the interval you have already paid for, and you keep full access until the end of it.
We do not refund part-used intervals, except where the law gives you a right to a refund. If you believe you were charged in error, contact us and we will look at it properly.
Your 14 day right to change your mind
If you are a consumer under EU law, meaning an individual acting outside your trade, business, craft or profession, you have 14 days from the day this agreement is concluded to withdraw from it, without giving a reason and without penalty. Ojapest is a digital service, so this right cannot be waived, and we do not ask you to waive it.
To withdraw, send us a clear statement by email to hello@ojapest.com, or use the model form linked below. It is enough that you send it before the 14 days are up; it does not have to reach us in time.
By starting to use Ojapest during the free period you are asking us to begin supplying the service straight away. If you then withdraw, we may charge a proportionate amount for what you actually used. During the free period that amount is zero, because you have paid nothing.
Separately, and whether or not you are a consumer, we make everyone the same promise: tell us within 14 days of your first payment that you want to stop, and we refund that payment in full. One email is enough.
Price changes
If we change the price, we will tell you by email at least 30 days before it affects you, and the change will only apply from your next renewal. If you do not want to continue at the new price, you can cancel before it takes effect.
If a payment fails
If a renewal payment fails, we retry it over a short period and email you. During that time your account keeps working normally.
If payment is not resolved, your public booking page stops accepting NEW bookings. Nothing you have already taken is affected: appointments already booked stay in your calendar, your clients keep working cancellation and management links, and you can still issue refunds. We will never hold a client's money hostage over a billing problem between you and us.
You can restore your page at any time by updating your payment method.
Deposits are between you and your client
Deposits are charged directly to your own Stripe account. You are the seller and the payee (merchant of record) for every deposit. Andre Blunt Kft never receives, holds or owns that money, and it never passes through an account of ours. Where you ask Ojapest to issue a refund, we pass that instruction to Stripe on your account and on your behalf: the money moves from your balance, never from ours.
This means refunds, chargebacks, disputes, and any tax on the money you take are yours to handle. If a client disputes a deposit, the disputed amount and any fee are taken from your Stripe balance, and you are the one who must respond in Stripe.
If a client reverses a payment, or if your Stripe balance cannot cover a refund, a chargeback, a fee or a penalty, Stripe may recover the shortfall from us as the platform. If that happens you reimburse us the amount we actually paid, within 14 days of our written request, and we may set it off against anything we owe you. This does not apply where the shortfall was caused by our own breach or our own error.
Ojapest does not issue invoices or receipts to your clients and does not report anything to a tax authority on your behalf. Issuing the right document for each payment, and reporting it where your law requires, is yours.
Your subscription to us and the deposits you take from clients are entirely separate payments and are never netted against each other.
Your data and your clients' data
You own your content and your client list. You can export or delete it, and if you close your account we delete it in line with our Privacy Policy.
For your clients' personal data, you are the data controller and Andre Blunt Kft is your processor: we handle that data on your instructions, only to run the service for you. You are responsible for having a lawful basis to collect it and for telling your clients how you use it.
We do not sell your data or your clients' data, and we do not contact your clients for our own marketing.
The detail of that processor relationship is set out in our Data Processing Agreement, published at ojapest.com/dpa. It gives effect to Article 28(3) GDPR and is incorporated into and forms part of this agreement. By subscribing you accept it, and no separate signature is required. It applies whether or not you pay us, because the processor relationship exists either way.
Who else processes your data
We use the following sub-processors to run Ojapest. Each is engaged under its own data processing agreement, which includes the European Commission's Standard Contractual Clauses for any transfer outside the EEA.
Supabase: Database, authentication and file storage. Region: eu-central-1 (Frankfurt, Germany).
Vercel: Hosting and server functions. Region: fra1 (Frankfurt, Germany).
Stripe: Card payments and subscription billing. Region: Stripe Payments Europe Limited, Ireland.
Resend: Transactional email. Region: United States.
Billingo: Hungarian invoicing and NAV Online Szamla reporting. Region: Hungary.
Your database records and the files you upload are stored in the European Union, and the server functions that read them run in the European Union. We will tell you by email before we add or replace a sub-processor, so you have the chance to object.
Acceptable use
Use Ojapest for genuine bookings for a real business. Do not use it for anything unlawful, do not impersonate anyone, and do not attempt to disrupt, probe, or overload the service.
You are responsible for what happens under your account, including anything done by anyone you give access to.
Suspension and ending this agreement
We may suspend or close an account that breaks these terms, is used unlawfully, or puts the service or other users at risk. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.
If we close your account without cause, we refund the unused part of your current interval.
You can close your account at any time.
Availability and liability
We work to keep Ojapest available and correct, but we do not promise it will be uninterrupted or error free. We are not liable for bookings you lose through downtime, for a client who does not turn up, or for anything you agree with a client.
Nothing in this agreement limits or excludes liability that the law does not allow us to limit or exclude. That includes liability for damage caused intentionally, and for damage to life, physical integrity or health. Subject only to that, our total liability to you under this agreement in any 12 month period is limited to the greater of the fees you paid us in that period and EUR 140. If you are a consumer, this limitation applies only so far as the law of the country where you live allows.
This limit does not apply to our obligations under data protection law.
Changes to this agreement
If we make a material change, we will email you at least 30 days before it takes effect. Continuing to use Ojapest after that means you accept the change. If you do not accept it, you can cancel.
Law and disputes
This agreement is governed by Hungarian law and the courts of Hungary have jurisdiction. If you are a consumer, none of that removes the protection of the mandatory rules of the country where you habitually live, and you may bring a claim in the courts of that country. We will only bring a claim against you in the courts of the country where you live.
